Court Dismisses Rosa Peral's Claim Against Netflix Over Daughter's Rights

In a significant legal ruling, a court in Vilanova i la Geltrú, Barcelona, has rejected a lawsuit filed by Rosa Peral against Netflix regarding alleged violations of her daughter's right to honor in the streaming series 'El cuerpo en llamas.' This decision comes after the father of Peral's daughter withdrew his own lawsuit, leaving only Peral's claim against the production company pending.

As reported by El Periódico and confirmed by legal sources to EFE, the first instance court number 1 concluded that Peral's attempt to represent her daughter in the lawsuit was invalid. Rosa Peral, previously sentenced to 25 years in prison for her involvement in the notorious 'Guardia Urbana' crime, had filed the claim on behalf of her daughter, however, the court ruled that only the father, with whom she was separated at the time of the crime, holds the legal rights to exercise such claims on behalf of the child.

Peral was convicted alongside her lover, Albert Pérez, also a police officer, for the murder of their colleague, a complex case that has been dramatized in the Netflix series. In her lawsuit against the streaming giant and production company Arcadia, Peral sought nearly 30 million euros for the alleged infringement of her and her daughter's rights to honor, image, and privacy.

During a hearing in March, the judge instructed the child's father to communicate his intentions regarding the claim within ten business days. With the deadline passing without a response from him, the judge dismissed the claim concerning potential breaches of the minor's rights.
