Dani Alves' Rape Conviction Overturned: A Judicial Reassessment
Former Brazil international Dani Alves has seen his rape conviction overturned on appeal, marking a significant turn in a high-profile legal case. In February 2024, a court sentenced Alves to a minimum of four years and six months for the rape of a 23-year-old woman at a Barcelona nightclub in December 2022. After spending over a year in remand, he was released under legal supervision shortly thereafter.
The appeal was presided over by a court comprising two female judges and one male judge, who ruled unanimously that the conviction was unsafe. The court noted a series of gaps, inaccuracies, inconsistencies, and contradictions related to the facts, the judicial assessment, and the outcomes of the original trial. The judges specifically criticized the victim's claims of experiencing non-consensual sex in a VIP bathroom at the Sutton nightclub on New Year's Eve of 2022, describing her as an unreliable witness whose testimony could not be substantiated. They concluded that her narrative did not align with reality.
In their ruling, the judges emphasized that Alves’ right to the presumption of innocence was violated during the trial. Amidst the initial conviction, prosecutors had sought a nine-year sentence for the former athlete. The court mandated Alves to pay €150,000 (approximately $125,000) in compensation to the victim, alongside prohibitions on approaching her home or workplace and any means of communication for a duration of nine years.
At the time of the original sentencing, Tania Vergè, then Catalan equality minister, hailed the ruling as a significant milestone, given the increasing scrutiny faced by high-profile footballers accused of sexual offenses and previously evading prosecution.
Dani Alves, who enjoyed a celebrated career with prestigious clubs such as Sevilla, Barcelona, Juventus, and Paris Saint-Germain, has also represented Brazil 126 times, participating in three World Cups, and was instrumental in the team's victories in two Copa Américas and an Olympic gold medal. He was with the Mexican club Pumas at the time of his arrest, which led to an immediate termination of his contract.
