Juana Rivas Files New Complaint Against Ex-Partner for Gender-Based Violence

Juana Rivas, a Spanish woman, has taken legal action against her ex-partner, Francesco Arcuri, following a series of allegations of gender-based violence. On Wednesday, her legal team formally submitted a complaint to the women's violence court, accusing Arcuri of psychological violence and harassment due to over 90 calls he allegedly made since December 22.

The situation stems from a custody arrangement that allowed Rivas’s youngest child, who is currently 11 years old, to visit her in Spain after being granted a special permit from Italian courts. This visit was intended to last only a few days and was made possible to allow the child to spend time with Rivas and their older sibling, who is of legal age and resides with her.

According to Rivas's legal representatives, the unwarranted and excessive calls from Arcuri violated the boundaries set by Rivas and amounted to psychological abuse as he tried to impose his presence in her life and the lives of their children. The accusations highlight a troubling pattern of behavior that her lawyers characterize as habitual gender violence, with implications of vicarious violence aimed at controlling and intimidating Rivas.

Recognizing the potential danger posed by Arcuri’s repeated attempts to reach Rivas, the complaint has requested several protective measures, including a restraining order to prevent him from contacting her. Additionally, Rivas’s legal team is advocating for the minor child, currently residing in Spain, to be placed in her custody, as they believe it will safeguard the child's welfare.

The legal team pointed out that the Instruction Court 4 of Granada had previously issued a provisional order on January 7, which prevented the child from being returned to Italy, further emphasizing the need for protective measures for Rivas and her children.

As this case highlights ongoing concerns about gender-based violence, it underscores the importance of legal protections for victims. Rivas’s quest for justice not only reflects her individual struggle but also brings to light the broader societal issues surrounding the safety and rights of women and children in situations of domestic violence.
