Madrid City Council to Challenge Court Ruling on Low Emission Zones

The City Council of Madrid is set to appeal a recent ruling by the High Court of Justice of Madrid (TSJM) that has nullified the capital's Low Emission Zones. This announcement was made by Borja Carabante, the delegate for Urbanism, Environment, and Mobility, during a press conference following the Governing Board meeting.

Carabante informed the media that the City Council's legal services have thoroughly reviewed the ruling and are prepared to file an appeal before the Supreme Court. He emphasized that the Low Emission Zones, which were rendered ineffective by the court's decision, remain operational since the ruling is not yet final.

Despite the court's decision, any fines issued under the existing regulations will remain in place, as the City Council considers the possibility of a cassation appeal.

The High Court's decision was largely influenced by concerns regarding the inadequacy of the economic impact report related to the measures stipulated in the municipal ordinance. The ruling raises significant questions about the future of environmental regulations and initiatives aimed at reducing urban pollution in Madrid.

As the appeal process unfolds, the City Council is expected to advocate strongly for the reinstatement of these Low Emission Zones, which have been pivotal in the city’s efforts to combat air pollution and promote sustainable urban mobility.
