Madrid Court Dismisses Begoña Gómez's Complaint Against Judge Peinado
The Superior Court of Justice of Madrid (TSJM) has ruled against Begoña Gómez's complaint filed against Judge Juan Carlos Peinado, who is currently investigating her. The complaint included allegations of a continued crime of prevarication and violations related to disclosing secret procedural actions. The court's decision aligns with the stance of the Prosecutor’s Office, indicating a lack of evidence to support Gómez's claims of judicial misconduct.
This ruling marks the third dismissal of complaints against Judge Peinado within a month, following similar actions concerning complaints from journalist Máximo Pradera and Spanish Prime Minister Pedro Sánchez.
In detail, Gómez’s legal team contended that the head of the Court of Instruction Number 41 in Madrid had improperly disclosed confidential accusations and procedural actions. This alleged breach, they argued, resulted in significant harm to Gómez, as the integrity of the investigation was compromised while she remained unaware of many key elements. The media subsequently broadcast aspects of the case, which her lawyer, Antonio Camacho, highlighted as problematic given the case's secretive nature.
Gómez, who is married to the Prime Minister, also argued that Judge Peinado had issued unjust decisions that appeared arbitrary, including verbal communications of judicial resolutions.
Despite the seriousness of the allegations, the TSJM has found no substantive evidence to validate Gómez’s complaints, reinforcing the independence of the judiciary in Spain against allegations of improper conduct.
