Madrid Prosecutors Recommend Archiving Case Against Former Deputy Íñigo Errejón Amid Insufficient Evidence

The Madrid Prosecutor's Office has requested Judge Adolfo Carretero to archive the case against former deputy Íñigo Errejón regarding the alleged sexual assault of actress Elisa Mouliáa. According to the Prosecutor's Office, there were insufficient criminal indications to pursue an indictment. Sources from the Madrid Prosecutor's Office have confirmed that the Public Prosecutor submitted a document to Investigation Court Number 47 in Madrid, addressing the appeal made by Errejón against the judge’s previous decision to process him. This request was made because all necessary investigative actions were completed to clarify the events, but the evidence did not sufficiently demonstrate the perpetration of the alleged crime. However, this does not imply disbelief in Mouliáa’s account. The Prosecutor's Office explained that while Mouliáa had stated she felt inhibited and did not genuinely consent to a sexual relationship as it unfolded, it was not established that Errejón was aware that the relationship was unwanted based on prior events and her conduct. It was highlighted that when she explicitly communicated her discomfort on two separate occasions, he ceased his actions. The case has been under investigation since November 14, when the judge decided to process Errejón, who was previously a parliamentary spokesperson for the coalition party Sumar, for an alleged sexual assault committed against Mouliáa during a night in late October 2021. This decision came after an extensive 13-month investigation that involved testimonies from both Errejón and Mouliáa, as well as from witnesses and psychiatrists. Furthermore, the judge requested both parties to present the conversations they exchanged around the reported dates. Mouliáa, through her complaint, stated that the alleged incident occurred after she and Errejón attended a book presentation, followed by drinks at a nearby bar. She indicated that she invited Errejón to join her at a friend's party out of politeness, despite having planned to attend without him. The judge originally found that sufficient indications of the case existed and that Errejón's defense did not completely discredit the prosecution's claims. Therefore, he believed it was premature to archive the case at that point. Mouliáa has sought a three-year prison sentence for Errejón, in addition to a claim for 30,000 euros as compensation for moral damages and any injuries resulting from the alleged sexual abuse. Furthermore, Mouliáa has requested the opening of a civil liability process against Errejón, including a requirement for him to post bail, with measures to investigate his financial situation if he fails to comply.
