Prosecutor Seeks Nine-Year Sentence for Former Footballer Álvaro Aguado in Sexual Assault Case
Prosecutors have requested a nine-year prison sentence for former RCD Espanyol footballer Álvaro Aguado, who is accused of sexually assaulting a club employee in the bathroom of a Barcelona nightclub in June 2024. The prosecution is also seeking 65,000 euros in compensation for the victim to cover moral damages and the psychological trauma inflicted by the alleged assault.
According to the indictment accessed by Efe, Aguado, 28 years old, reportedly assaulted the woman during the early morning hours of June 24 in the men's bathroom at Opium nightclub, despite her clear objections and pleas for him to stop. Witnesses claimed that she was in a state of shock and expressed her unwillingness to engage in sexual relations. Ultimately, the prosecutor notes that Aguado realized the gravity of his actions, dressed himself, and dismissed the woman with the statement, 'You don’t know me and I don’t know you either.'
The prosecution's provisional findings suggest that around 5 am on June 24, Aguado and the victim were initially found in a reserved section of the Opium nightclub, celebrating Espanyol's promotion to the First Division. Following a period of dancing together, Aguado allegedly took the woman's hand—claiming she was slightly dizzy from alcohol consumption—and led her away from the celebration. When a member of the nightclub staff intervened to stop their access through the designated stairs, Aguado is said to have taken her to the men's restroom where the alleged sexual assault occurred, involving both vaginal and oral penetration without the use of protection.
As a result of this tragic incident, the victim is reported to have suffered profound psychological consequences. In response to these facts, the prosecutor has charged Aguado with a crime of sexual assault, emphasizing the severity of the act and the subsequent impact on the victim's mental health.
Should Aguado be convicted, the prosecution seeks not only the nine-year prison sentence but also a monitoring order for ten years following his release. Additionally, they request a restraining order prohibiting him from approaching the victim within 1,000 meters or communicating with her for eight years after serving his sentence. In terms of civil liability, the public ministry is pursuing a total of 55,000 euros for moral damages and an additional 10,000 euros for the psychological repercussions suffered by the victim. This case highlights the ongoing issues surrounding sexual violence and the legal ramifications faced by those accused, especially in high-profile sectors such as sports.
