Supreme Court Judge Calls for Opinions on Attorney General's Temporary Suspension Amid Indictment
Supreme Court Judge Ángel Hurtado has requested input from involved parties regarding the request made by the association of prosecutors, APIF, to temporarily suspend Álvaro García Ortiz from his role as Attorney General and prosecutor. This request comes as an oral trial against him is set to commence concerning allegations of secret revelations.
Hurtado's decision, which was announced in an order on Thursday, lifts the previous suspension on the processing of the case against García Ortiz that was in place while the appeal regarding his indictment was being resolved. With the indictment now confirmed, the pathway for opening an oral trial has been cleared.
The judge may issue an order to initiate the trial for García Ortiz, wherein he could also decide on the APIF's request for temporary suspension unless he opts to handle this in a separate resolution after receiving feedback from the parties involved.
It is essential to note that the law mandates the suspension of any prosecutor accused of a crime by the Attorney General. However, García Ortiz's political appointment complicates the application of this regulation, leading to nuanced considerations in his case.
