Trial of Former RFEF President Luis Rubiales Begins Amidst Sexual Assault Allegations

Starting this Monday, the National Court in Spain will commence the trial of Luis Rubiales, the former president of the Royal Spanish Football Federation (RFEF), who faces serious charges of sexual assault and coercion against footballer Jenni Hermoso. This high-profile case stems from an incident that occurred on August 20, 2023, following the celebrations of the women's national team's victory at the World Cup held in Australia.

Rubiales is accused of kissing Hermoso on the lips without her consent during the formal greeting following the match, an act she has described as nonconsensual. The prosecution has outlined a stern case, seeking a prison sentence of two and a half years for Rubiales, who will appear alongside several other officials, including the former sports director of the men's national team, Albert Luque, former women's coach Jorge Vilda, and former RFEF marketing director Rubén Rivera. These individuals are alleged to have played a role in coercing Hermoso to characterize the kiss as consensual, exerting pressure on her and her family in the aftermath of the incident.

The allegations, as articulated by the prosecution, emphasize that Rubiales' behavior was not only surprising but also constituted a blatant lack of consent from Hermoso. Deputy prosecutor Marta Durántez has highlighted the subsequent campaign of harassment aimed at Hermoso, aimed at compelling her to withdraw her assertions of assault and to align with Rubiales' narrative.

The case not only involves the prosecution but also sees Hermoso herself, alongside the Spanish Footballers Association (AFE), stepping forward as accusers, each demanding similar penalties as the public ministry, which include a prison sentence, disqualification from sports-related work for Rubiales, financial compensation of 50,000 euros, and a restraining order against further communication with Hermoso.

The trial's primary focus will be to establish that Rubiales' kiss, irrespective of any claims of it being consensual, constituted an assault due to the inherent power dynamics at play, given that he was in a position of authority over Hermoso.

In addition to testimonies from Hermoso, the proceedings will feature testimony from teammates and coaches, including Montse Tomé and Luis de la Fuente. Journalists from approximately 70 media outlets globally have been accredited to follow the trial, underscoring the intense public interest surrounding this case.

The incident involving Rubiales and Hermoso has sparked wider conversations about sexual violence against women.
